The detention of Binance executive Tigran Gambaryan has sparked legal action, as he sues the NSA and EFCC for alleged violations of his fundamental rights. According to a report by Premium Times, Gambaryan, represented by lawyer Olujoke Aliyu of Aluko and Oyebode Law Firm, filed an originating motion on 18 March before Justice Inyang Ekwo, seeking five reliefs.

Simultaneously, Nadeem Anjarwalla, Binance’s Africa regional manager who escaped custody on 22 March, also filed a separate suit before Justice Ekwo. Both suits, marked FHC/ABJ/CS/356/24 and FHC/ABJ/CS/355/24, name the Office of NSA and EFCC as respondents.

In their respective applications, Gambaryan and Anjarwalla sought similar reliefs. Gambaryan, a US citizen overseeing financial crime compliance at the crypto exchange platform, asserted that his detention and the seizure of his international travel passport violated Section 35 (1) and (4) of the Nigerian Constitution. He argued that such actions amounted to a breach of his fundamental right to personal liberty guaranteed by the Constitution.

Consequently, Gambaryan requested an order for his immediate release from custody and the return of his international travel passport. However, the legal battle underscores the complexities surrounding the case and the broader implications for individuals’ rights in the context of international legal frameworks. Despite Gambaryan’s plea, the intricacies of international law present formidable hurdles, necessitating a thorough examination of the case’s intricacies. Nonetheless, the request for immediate release and the return of his passport highlights the urgency and gravity of the situation at hand.

Moreover, the legal dispute illuminates the intricate balance between state sovereignty and individual liberties within the global legal landscape. As Gambaryan seeks his release and the restoration of his travel document, the case brings into focus the nuanced interactions between national jurisdictions and international legal mechanisms. Additionally, the broader implications for individuals’ rights underscore the importance of ensuring due process and equitable treatment within the international legal framework. Thus, while Gambaryan’s request is a pivotal moment in his legal journey, it also serves as a catalyst for broader discussions on the intersection of rights, sovereignty, and the rule of law in a globalized world.

  1. Proper investigation should be carried out before arresting anyone or he should have been called in for questioning other than drawing conclusions
